ORDER
This petition has been filed to direct the 2nd respondent police not to harass of the petitioner on the file of S-15, Selaiyur Police Station, Selaiyur, Kancheepuram, Tamil Nadu - 600 073.
2. The petitioner had sent a representation to the Commissioner of Police on 17.06.2021 and to the Inspector of Police, Selaiyur, stating that she stood as a guarantor for one Magima and borrowed a sum of Rs.1,20,000/- from one Manjula during December, 2018, for the treatment of the child of the said Magima. Thereafter, the petitioner has been making the
payments regularly. Up to May 2021, the petitioner paid a debt of Rs.1,86,000/- through on-line transaction and a sum of Rs.30,000/- in hand cash. Thus, the petitioner totally paid a sum of Rs.2,20,000/- to the said Manjula for the entire loan with interest. According to the petitioner, she had discharged the dues and liability. However, the respondent police called her for enquiry on 21.06.2021 through phone calls, which is not proper since no notice has been served on her.
3. The learned Government Advocate (Crl.Side) has submitted that one Manjula had lodged an On-line Complaint on 25.01.2021 against the petitioner. The complaint discloses that the petitioner by using the credit card of the said Manjula had purchased jewels to the tune of Rs.4 lakhs and promised to repay the said amount, but she failed. Now, the Bank is insisting the said Manjula to make the payments. Hence, enquiry has been initiated.
4. At this juncture, the learned counsel for the petitioner has given an undertaking that the petitioner is ready to appear before the respondent police to give her explanation and also produce the documents in support of her explanation.
5. Considering the above submissions and undertaking, this Court directs the petitioner to appear before the respondent police on 01.07.2021 and thereafter, as and when required.
6. With the above directions, this Criminal Original Petition is disposed of.
