Prayer: Original Petition filed under Section 11(4) of the Arbitration and Conciliation Act, 1996 praying to appoint Mr.Inbavijayan, G2, Plot No.108, Majestic Colony, Valasarawakkam, Chennai - 600 087 or any other person as it deems fit, as the sole Arbitrator under Section 11(b) of the Arbitration and Conciliation Act, 1966, as amended to resolve the disputes and differences arising between the parties under or in connection with the Original Bills of Lading (MTD No.) MFSR/US/006888, MFSR/US/006889, MFSR/US/006890 and MFSRR/US/006891, dated 15.03.2019.

ORDER

The learned counsels appearing on either side have agreed to refer the disputes to the Arbitrator and have also agreed to appoint Mr.R.Yasod Vardhan, learned Senior Advocate as an Arbitrator to resolve the disputes between the parties.

2. Accordingly, it is ordered as follows:

i) Mr.R. Yashod Vardhan, Senior Advocate, (R)21(8), VII Main Road, Raja Annamalaipuram, Chennai - 600 028, Ph:04424355397, (O)155, Linghi Chetty Street, Chennai - 600 001, Mobile: 9841075397, is appointed as the Arbitrator to enter upon reference and adjudicate the disputes inter se the parties. ii) The learned Arbitrator may, after issuing notice to the parties and upon hearing them, pass an award as expeditiously as possible, preferably within a period of six months from the date of receipt of the order. It is open to the respondent to raise all legal objections as to the 2/4

validity of contract.

iii) The learned Arbitrator is at liberty to fix his remuneration and other incidental expenses as per law.

iv) The proceedings may be conducted under the aegis of the Madras High Court Arbitration Centre and in accordance with the Madras High Court Arbitration Rules.

The Original Petition is, accordingly, allowed, leaving the parties to bear their own costs.
