ORDER

This Writ Petition has been filed to direct the 2nd respondent to cancel the patta standing in the name of the 5th respondent for the property morefully disclosed in the prayer to this writ petition.

2. Mr.R.P.Murugan Raja, learned Government Advocate, accepts notice on behalf of the respondents 1 to 4. Since no adverse order is passed against the 5th respondent in this writ petition, notice to the 5th respondent is dispensed with by this Court.

3. According to the petitioner, erroneously, pursuant to the UDR scheme, patta has been issued in favour of the 5th respondent for the property morefully disclosed in the prayer to this writ petition. According to the petitioner, he is the absolute owner of the subject property. He had given a representation on 29.09.2025 to the official respondents, Page No.2 of 6

requesting them to cancel the patta standing in the name of the 5th respondent. Since the said representation was not considered, the petitioner has filed this writ petition.

4. No prejudice would be caused to the respondents, if the petitioner's representation as stated supra is considered on merits and in accordance with law, after hearing the objections, if any, from the 5th respondent, the neighbouring land owners and any other third party, whom the 2nd respondent deems it fit to enquire, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation.

For the foregoing reasons, this Court directs the 2nd respondent to pass final orders, on merits and in accordance with law, on the petitioner's representation, dated 29.09.2025 seeking cancellation of patta for the property morefully disclosed in the prayer to this writ petition standing in the name of the 5th respondent and for issuance of patta in the name of the petitioner for the very same property, after giving due consideration to the supporting documents produced by the petitioner and Page No.3 of 6

after hearing the objections, if any, from the 5th respondent, the neighbouring land owners and any other third party, whom the 2nd respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
