This application has been filed to condone the delay of 560 days in filing the application to restore the S.A. No. 134 of 2015, which has been dismissed for default on 14.11.2016.

The Respondents have entered appearance through Counsel. Though the Learned Counsel for the Respondents has opposed the application, it is found that the reasons stated in the affidavit filed in support of the application are acceptable. Hence, delay is condoned. 3.

Having due regard to the length of the delay, the Appellant shall pay a sum of Rs.2,000/- as costs to the Respondents. The said sum of Rs.2,000/- has been paid today and the Learned Counsel for the Respondents has made an endorsement to that effect, which is recorded. Post the application to restore the Second Appeal to file on the next hearing on 11.04.2019.
