PRAYER :

Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st and 2nd Respondents to consider the representation dated 16.04.2022 and further to provide police protection to the petitioner, his family members and the employees engaged by the petitioner in continuing the mining operation situated at S.No.530/2A3, Myavadi, Madathukulam Taluk, Tirupur District licensed by the competent authority.

ORDER

The Writ Petition is filed seeking for a direction, directing the 1st and 2nd Respondents to consider the representation dated 16.04.2022 and further to provide police protection to the petitioner, his family members and the employees engaged by the petitioner in continuing the mining operation situated at S.No.530/2A3, Myavadi, Madathukulam Taluk, Tirupur District licensed by the competent authority. 2.It is the contention of the learned counsel for the petitioner that the 3rd respondent is causing disturbance and https://hcservices.ecourts.gov.in/hcservices/

nuisance to the petitioner's business and thereby he seeks protection from the police.

3.Learned Additional Public Prosecutor would submit that in this case summon has already been issued to the 3rd respondent and on receipt of the summon, only the advocate appeared before them and stated that the 3rd respondent would accompany him shortly for the enquiry, but he did not turn up. Accordingly, prays for appropriate order.

4.In view of the above, the respondent police is hereby directed to conduct further investigation with the 3rd respondent and if any cognizable offence is made out after conducting thorough enquiry, they can act as per law.
