PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, to direct the second respondent authorities to conduct enquiry by disposing of the petitioner's representation

O R D E R

The Writ Petition has been filed to direct the second respondent authorities to conduct enquiry by disposing of the petitioner's representation dated 10.04.2023 within such time as may be stipulated by this Court. 2.The learned counsel for the petitioner submitted that there is a dispute between the petitioner and one Kumar with regard to laying pipeline and in this regard, a suit in O.S.No.92 of 2023 is pending on the file of the learned District Munsif, Athur. Meanwhile, at the instigation of Kumar, the Inspector of Police, Thalaivasal, giving pressure to the petitioner to withdraw the civil case, else she would be implicated in a false case and lodged in prison. In this regard, she gave complaint to the District Superintendent of Police on 10.04.2023, for taking appropriate action. So far, no action has been taken, necessitating filing of this petition.

3.In response, the learned Government Advocate (Criminal side) submitted that second respondent has not received the complaint dated 10.04.2023. However, fourth respondent received a complaint dated 11.04.2023 from the petitioner. On the basis of this complaint, petition enquiry in C.S.R.No.151 of 2023 is pending.

4.In the said circumstances, this Court directs the second respondent to conduct proper enquiry, taking into consideration the pending civil suit in O.S.No.92 of 2023 and take appropriate action in the manner known to law. Fourth respondent is directed not to interfere with the pending civil dispute. 5.With the above direction, this Writ Petition is disposed of. No costs. 25.04.2023 ep Index :Yes/No Internet:Yes/No
