Petition filed under Article 226 of the Constitution of India for the issuance of writ of mandamus, directing the first and second respondents herein to confer the compassionate ground appointment to the petitioner's son by considering the representation dated 23.08.2012 and 23.07.2013.

With the consent of both sides, the writ petition is taken up for final disposal.

2. The husband of the petitioner was working as an Assistant Agriculture Officer. He died in harness on 26.03.2002.

3. The petitioner submitted an application before the third respondent to provide her compassionate appointment on 16.07.2002. Since there was a ban on recruitment by the Government, the documents submitted by her were returned. According to the petitioner, she submitted another representation on 07.03.2005 to provide compassionate appointment to her son. However, it did not elicit any response from the respondents, forcing the petitioner to again submit representations in this regard.

Since there was no follow up action, the petitioner has come up with this writ petition seeking for a direction to respondents 1 and 2 to provide compassionate appointment to her son by considering the representations, dated 23.08.2012 and 23.07.2013 within a stipulated period. However, there is no acknowledgment for having sent the said representations.

5. When the matter was taken up for hearing, the learned counsel for the petitioner has submitted that the petitioner would be satisfied if she is permitted to submit a fresh representation to respondents 1 and 2 setting out her grievance.

6. In view of the narrow prayer made, the petitioner is permitted to submit a fresh representation setting out her grievance to respondents 1 and 2 and in case any such representation is made, the same shall be considered and disposed of by respondents 1 and 2 on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly.
