This Civil Miscellaneous Petition has been filed to condone the delay of 2296 days in filing the above CMA.

2. Heard the learned counsel for the petitioner. Mr. Nithin, learned counsel undertakes to file vakalat for the sole respondent.

3. The learned counsel for the petitioners would aver that the accident is a fatal accident and on account of the untimely death of her husband-Gnanasekaran, the 1st petitioner/wife of the deceased Ganansekaran has no money to run her family and she has been struggling to maintain even her family consisting of her minor son and age old mother -in- law. Due to her financial constraint, there occurred a delay of 2296 days in filing the appeal. The delay in filing the appeal is neither wilful, nor wanton, but due to the above said reason. Thus he prayed for condoning the delay of 2296 days in filing the appeal.

4. Learned counsel for the sole respondent has got objections in allowing the petition as the appeal is filed after a period of about 6 years from the date of the award.

Accepting the averments made in the affidavit filed in support of this petition, this petition is allowed subject to the condition that the interest for the delay period of 2296 days shall stand waived. 30.10.2025 msr Note: The Registry is directed to number the appeal, if it is, otherwise in order.
