Respondent Prayer:- Petition has been filed under Section 24 of C.P.C., to withdraw H.M.O.P.No.435 of 2017 from the file of the Subordinate Court at Tambaram and transfer the same to the I Additional Family Court, Chennai to be tried alongwith HMOP No.1152 of 2017 pending before the I Additional Family Court, Chennai. O R D E R

This petition is filed to withdraw the petition in HMOP No.435 of 2017 pending on the file of the Subordinate Court, Tambaram and transfer the same to I Additional Family Court, Chennai to be tried alongwith the O.P No.1152 of 2017 pending on its file.

When this petition is taken up for hearing, the learned counsel appearing for the respondent has submitted that the respondent has no objection to transfer H.M.O.P.No.435 of 2017 pending on the file of the Sub Court, Tambaram, to the file of the I Additional Family Court, Chennai, to be tried alongwith O.P.No.1152 of 2017, pending on its file. He has also prayed for early disposal of the H.M.O.P.

3. Heard the learned counsel for the petitioner as well as the respondent.

4. In view of the submission made by the learned counsel for the respondent, the petition in H.M.O.P.No.435 of 2017 pending on the file of the Sub Court, Tambaram, is ordered to be https://hcservices.ecourts.gov.in/hcservices/

withdrawn and transferred to the file of the I Additional Family Court, Chennai to be tried alongwith O.P.No.1152 of 2017 filed by the petitioner. The learned Judge, Sub Court, Tambaram, is directed to transmit all the records pertaining to H.M.O.P.No.435 of 2017 to the file of the I Additional Family Court, Chennai, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the records, the learned I Additional Judge, Family Court, Chennai, is directed to dispose of the case, as expeditiously as possible, in any event not later than six months from the date of receipt of a copy of this order.

5. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs.

Consequently, connected miscellaneous petition is closed.
