O R D E R
(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 363 and 366 of I.P.C. in Crime No.Not Known of 2020, seek anticipatory bail.
2. The case of the prosecution as per the defacto complainant is that the petitioner has kidnapped the minor daughter of the defacto complainant. Hence, the defacto complainant lodged the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is aged about 23 years and he fell in love with the victim girl, since it was objected to by her parents, the victim girl eloped with the petitioner.
4. The learned Additional Public Prosecutor would submit that the petitioner had abducted the minor daughter of the defacto complainant, who is 16 years. He would submit that till date the victim girl has not been secured. He would further submit that a case https://hcservices.ecourts.gov.in/hcservices/
has been registered in Crime No. 599 of 2020 since it is found that the petitioner had kidnapped the victim girl, the case has been altered as per the appropriate provisions of law. Therefore, the learned Additional Public Prosecutor would vehemently opposed to grant anticipatory bail to the petitioner since the victim girl has not been secured so far.
5. Taking into consideration the fact and circumstances of the case and the victim girl has not been secured so far, this Court is not inclined to grant anticipatory bail to the petitioner.
