Respondent Criminal Revision filed under Section 397 r/w 401 of Cr.P.C. seeking to set aside the order passed in Crl.M.P.No.929 of 2020 dated 27.07.2020 on the file of the Judicial Magistrate, Kangayam and direct the learned Judicial Magistrate, Kangayam to return the Maruti 800 car bearing Reg No.TN-03-B-3058 seized in connection with Crime No.457 of 2020 on 08.05.2020 on the file of the respondent to the petitioner.

ORDER

This case is taken up through video conferencing.

2. This criminal revision has been filed seeking to set aside the order dated 27.07.2020 passed in Crl.M.P.No.929 of 2020 on the file of the Judicial Magistrate, Kangayam and direct the learned Judicial Magistrate, Kangayam to return the Maruti 800 car bearing Reg No.TN-03-B-3058 seized in connection with Crime No.457 of 2020 on 08.05.2020 on the file of the respondent to the petitioner.

Today, when the matter was taken up for hearing, the learned Government Advocate (Crl.Side) submitted that confiscation proceedings No.e/f/vz;/15-g/K-T/fh/f/-k/tp-jpUg;g {h;-2020 ehs;/ 03/07/2020 have been initiated by the Additional Superintendent of Police, P.E.W., Tiruppur District dated 03.07.2020 under Section 14 of the Tamil Nadu Prohibition Act, 1937 and that the petitioner has also given his reply to the show cause notice issued by the Adjudicating Authority.

4. In view of the above, this Criminal Revision Petition is closed with a liberty to the petitioner to work out his remedy in a manner known to law, as laid down in the Tamil Nadu Prohibition Act, 1937.
