A.No.1908 of 2020 in C.S.965 of 2008 C.V.KARTHIKEYAN,J.

A.No.1908 of 2020 has been filed by the Plaintiff to amend the cause title to show that the 1st defendant is now represented by the liquidator Mr.S.Ramasubramaniam. In the affidavit filed in support of the said application, it has been stated that the liquidator had filed a report on 20.02.2020, placing on record the orders of NCLT, Chennai and since the 1st defendant is now represented by its liquidator, it is only appropriate that the liquidator also participates in the present judicial proceedings. The liquidator would inform the Court about the further proceedings before the NCLT.

2. Heard the learned counsels for the other defendants also. In view of the fact that the liquidator is a necessary party to the present proceedings, since, the 1st defendant/ company has gone into the liquidation, the amendment is allowed and the registry is directed to carry out the necessary amendments as stated in the Judge's Summons.

3. The learned counsel for the plaintiff may file an amended copy of the plaint and also serve such copies to the defendants. The counsel for the plaintiff may

also issue notice to the liquidator, informing him that he has been made a party. C.V.KARTHIKEYAN,J.

rri If the liquidator deems it necessary to file any statement on behalf of the 1st defendant, permission is granted. Plaintiff to get necessary permission to proceed with the Suit.
