ORDER

The Project Director, National Highways Authority of India, Project Implementation Unit-Chithoor, Door No2-1272/1 F., B.V Reddy Colony, Chithoor-517001 is suo motu added as the 4 th respondent in this writ petition.

3/6 2.This writ petition has been filed for issue of writ of mandamus directing the 1 st respondent to deal with the appeal filed by the petitioner under Section 3G(5) of the National Highways Act and to pass orders within the time frame fixed by this Court.

3.Heard Mr.Vijayan Subramanian, learned counsel appearing on behalf of the petitioner, Mr.P.Sathish, learned Additional Government Pleader appearing on behalf of respondents 1 to 3 and Mrs.S.R.Sumathy, learned Standing Counsel appearing on behalf of the 4 th respondent.

4.Taking into consideration the facts and circumstances of the case and considering the fact that already an Award has been passed in this case by the 3 rd respondent and the same was put to challenge before this Court in W.P.No.23819 of 2022 and this Court disposed of the writ petition by an order dated 02.09.2022, directing the petitioner to file an appeal before the District Collector under Section 3G(5) of the Act and pursuant to which the petitioner also filed an appeal before the 1 st respondent on 04.06.2023 and the enquiry was

4/6 commenced by the 2 nd respondent and the National Highways Authority of India has also filed a counter in this case, there shall be a direction to the 1 st respondent 2 nd respondent (12445) to pass final orders, within a period of eight weeks from the date of receipt of copy of this order. 5.This writ petition is disposed of with the above directions.
