A.No.1744 of 2020 in C.S.No.69 of 2020 C.V.KARTHIKEYAN J, This application has been filed by the 3rd and 4th defendants, seeking condonation of six days in filing application to grant leave to defend the suit. 2.In the affidavit filed in support of the said application, it had been stated that the Summons for Judgment was served on 09.03.2020 and the application should have been filed within 10 days. However, the application could not be filed and the application had been filed immediately on opening of the High Court after the lock down was lifted owing to Covid-19 pandemic. There has been a delay of six days.
3.Heard the learned counsel for the respondents/plaintiffs. 4.In view of the fact that, it would only be in the interest of both the parties that any issue is decided on merits, the delay is condoned. 5.The application is allowed. No costs.
