ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.02.2026 for the alleged offences under Sections 8(c) read with Section 20(b) (ii)(B), 22(c), 25 and 29(1) of NDPS Act in Cr. No.84 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that based on a specific information about the illegal trafficking of narcotic substances, when the respondent police conducted enquiry, they found the accused 1 to 3 in illegal possession of 52 grams of Methamphetamine, 12.400 kgs of Ganja and 190 grams of OG ganja for sale and hence the case.

3. The learned counsel for the petitioner would submit that according to the case of the prosecution, this petitioner possessed 30 grams of Methamphetamine, which is only an intermediate quantity and this petitioner has no previous bad antecedents. The learned counsel would further submit that this petitioner has been implicated in this through the confession of the coaccused and the petitioner has been under incarceration since 03.02.2026 and prayed to enlarge the petitioner on bail.

The learned Government Advocate appearing for the respondent police would vehemently object the bail application on the ground that this case is a case of commercial quantity as the accused 1 to 3 were found in possession of 52 grams of Methamphetamine, 12.400 kgs of Ganja and 190 grams of OG ganja and investigation is still pending.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. According to the prosecution, this case is of commercial quantity and investigation is still pending. Therefore, it is pre-mature stage to go into the quantity possessed by the petitioner alone. Moreover, this Court could not find any material to overcome the rigors under Section 37 of NDPS Act. Therefore, this Court is not inclined to enlarge the petitioner on bail.

7. Accordingly, this Criminal Original Petition is dismissed. 20-04-2026 MJS Note:
