ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 08.12.2020 for the alleged offence punishable under Section 399 I.P.C., in Crime No.142 of 2009 pursuant to the NBW issued on 19.03.2019 in P.R.C. No.5 of 2010 by the learned Judicial Magistrate, Thiruvottiyur, Tiruvallur District, seeks bail.

2. The case of the prosecution is that when the respondent Police went to usual rounds near K.H.Ennore Road, nearby ETPS Quarters, the petitioner and other three accused were standing in a suspicious manner. When the respondent enquired them, they came to know that they are planning to commit robbery at the nearby bank. Hence, the complaint has been registered.

3. It is seen from the records that this is the fourth bail petition filed by the petitioner. Earlier bail applications were dismissed by this Court on 21.01.2021, 22.04.2021 and 31.08.2021 in Crl.O.P.Nos.664, 3719 and 8946 of 2021, respectively.

4. The learned Government Advocate (Crl. side) submitted that there is no change in circumstances after the previous order was passed on merits. Hence, the learned Government Advocate vehemently opposed to grant bail to the petitioner.

5. In view of the submission made by the learned Government Advocate, no change of circumstances arises for considering the fourth bail petition . Hence, this Criminal Original petition is dismissed.
