J U D G M E N T

This appeal has been preferred by the Department as against the order of acquittal passed in C.C.No.555 of 1989 on 29.03.2004, by the learned Judicial Magistrate, Tiruchengode.

2. Learned Senior Special Public Prosecutor, Government of India filed petition to withdraw this criminal appeal, in view of the fact that the respondent has paid the amount and it was compounded.

3. Along with the said petition, the learned Senior Special Public Prosecutor also filed the letter of the Chief Commissioner of Income Tax, Trichy, dated 27.03.2015, wherein in paragraph 6 it is stated as under:

"The Senior Special Public Prosecutor for the Government of India, Chennai shall take necessary steps to withdraw the appeal filed by the Department before the Hon'ble Madras High Court and further necessary action under intimation to the department."
