ORDER

This writ petition has been filed against the impugned order dated 02.12.2021 passed by the 2nd respondent.

2. When this matter was taken up for hearing, the learned counsel for the 3rd respondent would submit that a suit in OS.No.736 of 2020 was already filed by the 3rd respondent with regard to the very same dispute. Subsequent to the filing of this petition, the judgement and decree came to be passed in the aforesaid suit on 02.09.2025, whereby the impugned order passed by the 2nd respondent was confirmed and the execution of Will and settlement deed was declared as null and void. Hence, he would submit that the prayer in this petition has become infructuous and prays for dismissal of this petition.

3. In view of the above, it is clear that nothing survives in this petition. Therefore, by recording the submission made by the 3rd respondent, this writ petition is dismissed as infructuous. No cost. The petitioner is granted liberty to file an appeal suit against the judgement dated 02.09.2025 passed in OS.No.736 of 2020.
