O.P.No.777 of 2018 R.SUBRAMANIAN.J., The petitioner seeks issuance of Probate for the Will dated 05.03.2003 executed by late S.Rangarajan who died on 05.02.2004.

2. The petitioner and another son of the Testator had been appointed as the Executors. One of the Executors had died, so the petitioner has come forward with this Original Petition for grant of Probate. The petitioner has been examined as PW1. He has produced the Original Will as Ex.P1. The death certificate of Testator has been produced as Ex.P2. The death certificate of the Testator's wife R.Padma has been produced as Ex.P3. The legal heirship certificate has been produced as Ex.P4. The original death certificate of the other Executor R.Vasudevan has been produced as Ex.P5. The petitioner has also examined one D.Rajasekaran as PW2. He had deposed as to the execution of the Will by the Testator and its attestation by himself and one D.Dayanandasekaran. The learned counsel for the respondents 1 to 8 has no objection for grant of Probate.

3. In the light of the evidence, this Original Petition is allowed granting Probate for the Will dated 05.03.2003, in favour of the petitioner. 25.04.2019
