Today when these petitions are taken up for hearing, which are posted under the caption "for dismissal", there is no representation for the petitioners. These petitions are filed to (i) condone the delay of 433 days in filing the petition to set aside the abatement caused due to the death of the 4th respondent, (ii) set aside the abatement caused due to the death of the 4th respondent and (iii) bring on record the respondents 7 to 10 herein as the legal representatives of the deceased 4th respondent and rank them as respondents 7 to 10 in S.A. No.586 of 2010, respectively.
2. A perusal of the records shows that these Civil Miscellaneous petitions are of the year 2016 and till date no batta was paid by the appellants with regard to the respondents 7 to 10 till date. 3.In view of the above, these Civil Miscellaneous Petitions are dismissed for non prosecution.
