This matter is listed today under the caption "for being mentioned" at the instance of the learned counsel for the petitioner.

2. The petitioner / tenant filed an affidavit dated 20.09.2019 whereby he undertook to hand over vacant possession on or before 30.11.2019 and to pay a sum of Rs.75,000/- towards arrears of rent and the future rent as and when it becomes due till the date of delivery of possession.

3. When the matter is taken up today, learned counsel appearing for the parties would submit that possession was handed over to the respondent / landlord.

However, arrears to the tune of Rs.75,000/- and future rent were not paid.

4. Since the respondent / landlord has taken possession, no further order is necessary in this Civil Revision Petition. However, liberty is given to the respondent to initiate separate proceedings to recover the arrears amount, whatever is pending, till the date of handing over the possession from the petitioner.
