Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To suspend the sentence imposed by the Learned 1st Additional District cum Sessions Judge, Cimbatore made in Crl.A.No.399 of 2018 dated 21.02.2019 partly allowing the order in SC.No.28 of 2015 on the file of I Additional Sessions Judge, Coimbatore pending disposal of the above Crl.R.C.No.388 of 2019. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.T.SHANMUGAM, Advocate for the petitioner, and of M/S.KRITIKA KAMAL P. Govt. Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- Crl.MP.No.5773 of 2019 has been filed to suspend the sentence imposed on the petitioner vide order dated 31.

08.2018 passed in S.C.No.28 of 2015 on the file of 1st Additional Assistant Sessions Court, Coimbatore, confirmed by judgement dated 21.02.2019 passed in C.A.No.299 of 2018 on the file of 1st Additional District-cumSessions Court, Coimbatore and to enlarge the petitioner on bail. https://hcservices.ecourts.gov.

2. Since the petitioner/accused has not surrendered before the trial Court, this Criminal Miscellaneous Petition is dismissed.

3. The trial Court is directed to secure the accused.

4. Liberty is given to the petitioner/accused to file a fresh petition seeking suspension of sentence and bail after he is taken into custody.
