..Respondents R3 is suo motu impleaded as third respondent by an order dated 08.09.2020 in W.P.No.12143 of 2020 Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the second respondent to consider the representation of the petitioner dated 05.05.2020 in connection with demarcation of his land bearing R.S.No.166/8/A measuring to an extent of 1701 Sq.ft., situated at Saram Revenue Village, Puducherry.

ORDER

On the consent given by either side, the main writ petition itself has been taken up for final hearing.

2. This writ petition has been filed for the issuance of writ of mandamus directing the second respondent to consider the representation made by the petitioner on 05.05.2020, to conduct the survey of the property and demarcate the property and make necessary entry in the revenue records.

3. The case of the petitioner is that he purchased the subject property by virtue of a registered sale deed dated 29.01.2020. The further case of the petitioner is that he wanted to put up a compound wall around the property. Hence, he made a representation on 05.05.2020 to the second respondent and requested for survey of the property and to demarcate the same by marking the boundary stones. Since the representation was not considered, the present writ petition has been filed before this Court seeking for appropriate directions.

4. Mr.B.Nambi Selvan, the learned Additional Government Pleader appearing for the respondents submitted that The Tahsildar, Oulgaret, Saram Revenue Village, Puducherry, is the competent authority to consider the request made by the petitioner.

5. Accordingly, The Tahsildar, Oulgaret, Saram Revenue Village, Puducherry is suo motu impleaded as a third respondent in this writ petition.

6. Taking into consideration the facts and circumstances of the case, there shall be a direction to the petitioner to submit a fresh representation to the third respondent along with all the relevant documents. The third respondent, on receipt of the application shall deal with the same and take an appropriate decision strictly in accordance with law, within a period of six weeks from the date of receipt of application from the petitioner.

7. With the above direction, this writ petition is disposed of. No costs.
