Crl.M.P.NO.4338 of 2016 in CRL.O.P.NO.1036 of 2016 K.KALYANASUNDARAM,J.

This miscellaneous petition has been filed to modify the condition to deposit the conditional amount Rs.5,00,000/- to the credit of Crime No.1 of 2016 on the file of the respondent as imposed by this Court in Crl.O.P.No.1036 of 2016 by interim order dated 19.02.2016 on the file of this Court.

2.The learned counsel appearing for the petitioner would submit that the petitioner is a lady aged about 26 years and she was working in the defacto complainant finance company and after registration the case she lost her employment. It is further submitted that at the time when the Anticipatory bail petition in Crl.O.P.No.1036 of 2016 was taken up for hearing on 19.02.2016, the petitioner has submitted that to show her bonafide she was ready and willing to deposit Rs.5,00,000/-. Subsequently, she could not mobilize the said amount.

Therefore, she seeks for modification.

3.Heard the learned counsel for the Intervener and the learned Government Advocate [Crl. Side] appearing for the first respondent.

4. Considering the submission made by the learned counsel appearing for the petitioner, the order of this court dated 19.02.2016 in Crl.O.P.No.1036 of 2016 is modified to the effect that the petitioner shall deposit Rs.4,00,000/- instead of Rs.5,00,000/- to the credit of Crime No.1 of 2016 within a period of one week from the date of receipt of a copy of this order and the petition is ordered accordingly.
