Respondents PRAYER: This Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Habeas Corpus, directing the 3rd respondent to grant parole to the detenu and convict Mr. Ramachandran Kalirathinam (prisoner No. 12082), confined in Central Prison, Coimbatore, Tamil Nadu, and leave for a period of 2 weeks time.

O R D E R

(Order of the court was made by N.KIRUBAKARAN,J.) The matter is heard through "Video Conferencing".

2. The petition has been filed by the wife seeking leave to the convict as convict's father is critically ill.

3. Heard the parties and perused the materials available on record.

4. The Probationary Officer's report would confirm that the convict's father is seriously ill. Even though he was earlier admitted in Malar Hospital, the Doctors expressed that there is no hope of survival. Therefore, the convict's father is now in the residence of the petitioner.

5. Considering the Probationary Officer's report, this Court is inclined to grant 21 days leave to the convict commencing from 04.09.2020 to 24.09.2020 and the convict viz., Mr. Ramachandran Kalirathinam (prisoner No. 12082), now confined in Central Prison, Coimbatore, shall be released from the prison on 04.09.2020 at 11.00 a.m, without escort and he shall surrender before the prison authorities at 5.00 P.M. on 24.09.2020. During the leave period, the convict shall report before jurisdictional Police Station, on every Monday at about 11.00 a.m. Accordingly, this petition is ordered.
