ORDER

This writ petition is filed to direct the respondents 2 and 3 to issue patta in the name of the petitioners for the land bearing Plot Nos.23, 28,30 and 41 comprised in Survey No.217/2A situated at Potheri Village, Chengalpattu Taluk and District as per the proceedings No.Na.Ka.1084/2020/AA2 dated 18.08.2020 issued by the third respondent.

Learned counsel for the petitioners would submit that the petitioners have purchased a lands bearing Plot Nos.23, 28, 30 and 41, measuring an extent of 2760 sq.ft., 2520 sq.ft., 3050 sq.ft., and 2400 sq.ft., respectively, situated at Potheri Village, Chengalpattu Taluk and District and they were in the absolute possession and enjoyment of the aforesaid lands. This being the case, the first respondent purported to acquire the aforesaid lands for the purpose of developing Maraimalai Nagar Scheme by the fourth respondent. However, the same was lapsed. On the lapse and withdrawal of acquisition proceedings, the respondents 2 and 3 initiated proceedings for correction of revenue records. Since the aforesaid lands were mutated in favour of the fourth respondent, the

petitioners herein made a representation dated 15.06.2020 before the third respondent for mutation of patta. Based on which, the third respondent vide proceedings dated 18.08.2020 directed to mutate the patta in favour of the petitioners. However, the respondents 2 and 3 has failed to mutate the patta for the said lands, till date. Hence, the petitioners have come forward with the present writ petition.

Learned Additional Government Pleader appearing for the respondents would submit that the land was acquired by the Chennai Metropolitan Development Authority and award was also passed on 17.09.1986 and the compensation amount was kept under Civil Court Deposit, as per Section 31(2) of the Land Acquisition Act. By mistake of facts, the third respondent has wrongly passed an order dated 18.08.2020 to make correction in the revenue records, which is kept in abeyance.

4. Heard the learned counsel on either side and perused the materials available on record.

5. According to the respondents, the lands were acquired by the Chennai Metropolitan Development Authority and patta was also mutated on their favour. Moreso, award was also passed and the same was kept under Civil Court Deposit. As far as petitioners are concerned, they are still in possession

of the subject property and enjoying the same.

6. Assuming that the acquisition was made, liberty is granted to the petitioners to make a fresh application for re-conveyance of the aforesaid land before the respondents. On such receipt, the respondents are directed to pass orders on merits and in accordance with law.

With the aforesaid direction, this writ petition stands disposed of. No costs. 02-04-2026 Index: Yes/No Speaking/Non-speaking order VM
