The petition in Crl.M.P.No.6111 of 2023 has been filed to modify the condition No.8 that the petitioner shall deposit the original title deeds of immovable properties (stand in the name of the petitioner or in the name of his friends or his relatives) worth about Rs.10,00,000/- (Rupees Ten Lakhs only) to the credit of crime No.63 of 2022, which is imposed in Crl.O.P.No.4641 of 2023 dated 23.03.2023.

The Petition in Crl.M.P.No.6112 of 2022 has been filed to extend the time to comply with the conditions as imposed by this Court vide order dated 23.03.2022 in Crl.OP.No.4641 of 2023.

The learned counsel for the petitioner submitted that this Court, by an order dated 23.03.2023, had granted bail to the petitioner in Crl.O.P.No.4641 of 2023 with a condition to deposit the original title deeds of immovable properties (standing in the name of the petitioner or in the name of his friends or his relatives) worth about Rs.10,00,000/- to the credit of crime No.63 of 2022. He further submitted that in alternative, the petitioner is ready and willing to deposit a sum of Rs.10,00,000/- in fixed deposit in any one of the Nationalized Banks to the credit of Crime No.63 of 2022 and to produce the original fixed deposit receipt before the concerned Court. Thereby, he seeks for modification of the condition. Page No.1/4

3. Heard both sides.

Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side, this Court is inclined to modify the Condition (Paragraph 8), which shall be read as follows:- " 8. Accordingly, the petitioner is directed to deposit a sum of Rs.10,00,000/- (Rupees Ten lakhs only) in fixed deposit in any one of the Nationalized Banks and produce the original fixed deposit receipt before the concerned Court to the credit of Crime No.63 of 2022 and on such deposit and production of proof, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate No.1, Poonamallee, on condition that the petitioner shall execute a bond for a sum of Rs.

The other conditions imposed by this Court in Crl.O.P.No.4641 of 2023 on 23.03.2023 shall remain unaltered. Further period of two weeks time is Page No.2/4

granted to the petitioner to surrender and execute sureties before the concerned Magistrate as imposed by this Court, from the date on which the order copy made ready. Failing which, the petition for anticipatory bail shall stand automatically dismissed and no further extension will be granted.

5. In view of the above, these Criminal Miscellaneous Petitions are ordered.
