ORDER

This petition has been filed seeking to withdraw the H.M.O.P.No. 65 of 2024 pending on the file of Family Court, Dindigal and to transfer the same to Family Court, Coimbatore.

2. It is submitted by the learned counsel appearing for the petitioner that marriage of the petitioner with respondent was solemnized on 04.11.2022 at Palani. Subsequently, on account of some issues between the parties, the respondent has filed petition in H.M.O.P.No. 65 of 2024 on the file of Family Court, Dindigul seeking divorce from the petitioner on the ground of cruelty.

3. It is also submitted by the learned counsel appearing for the petitioner that the petitioner is residing in Coimbatore. The petitioner's parents are old and suffering from several health diseases. There was no source of income for the petitioner. That apart, the respondent and his family members had already tortured the petitioner and attempted to murder the petitioner. So there was no safety for the petitioner and difficult to attend Family Court, Dindigal which is about 200 kms. Therefore, sought for transfer.

4. Today this matter is posted under the caption 'for orders'. Notice taken out to the respondent has already been served. However, no representation on behalf of the respondent. Therefore the following orders Page No 2 of 4

are being passed.

5. Considering the submission made by learned counsel for the petitioner and on perusal of records, this petition is allowed. The H.M.O.P.No. 65 of 2024 pending on the file of Family Court, Dindigul is withdrawn and ordered to be transferred to Family Court, Coimbatore. The learned Presiding Officer of the Family Court, Dindigul is directed to dispatch the entire case records pertaining to H.M.O.P.No. 65 of 2024 duly indexed to the Family Court, Coimbatore as quickly as possible.
