ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 3, 5 & 6 of Explosives Substances Act, 1908 and Section 125(b) of BNS, 2023 @ Sections 3, 5 & 6 of Explosives Act, 1908 and 105 of BNS, 2023 in Crime No.43 of 2026, on the

file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner had stored explosive substance in an undesignated place which resulted in the death of an innocent person. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioner has one previous case of similar nature, in which two persons died. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions.

6. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the petitioner has not mended his conduct despite the liberty granted earlier by this Court in a previous application. Hence, this Court

is of the view that the petitioner does not deserve anticipatory bail. Accordingly, this Criminal Original Petition is dismissed. 09-04-2026 DRL To 1.The Inspector of Police, Papparapatti Police Station, Dharmapuri District.
