ORDER

The petitioner apprehends arrest for the alleged offence under Sections 126(2), 296(b), 115(1), 351(2) of BNS read with Section 4 of Women Harassment Act in Crime No.55 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, petitioner along with other accused assaulted the defacto complainant in hands and also abused in filthy language . Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) would reiterate the prosecution case and submitted that the petitioner has got three previous cases and further more A2 to A5 are still has to be identified and unless the petitioners are taken into custody, the question of identifying the other person becomes difficult. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. As rightly pointed out by the learned Government Advocate (Crl. Side) that unless the petitioner is secured, the other persons cannot be identified in this case. Hence, this Court is of the view that the petitioner does not deserve anticipatory bail.
