O R D E R

(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 16.07.2020 for the offences punishable under Section 5(1) and 6 of Protection of Children from Sexual Offences Act, 2012 and 294(b), 506(1) IPC, in Crime No.11 of 2020, seeks bail. 2.The case of the prosecution is that the petitioner had threatened the minor daughter of the defacto complainant and committed penetrative sexual assault. The further allegation against the petitioner is that when the same was questioned by the defacto complainant and her relatives, he had also threatened them with dire consequences.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that it is a case of love affair which has been falsely projected as a case of rape. He would further submit that the petitioner is in custody for the past 35 days. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Government Advocate (Crl. Side) would submit that the petitioner had committed penetrative sexual assault on the minor daughter of the defacto complainant by threatening her and when the same was questioned by her parents and relatives, he had also threatened them. He would further submit that the investigation is in initial stage.

5.Taking into consideration of the facts and submissions so made by the learned counsels on either side. This court is not inclined to grant bail to the petitioner.
