Writ Petition filed under Article 226 Constitution of India, to issue Writ of Mandamus, to direct the respondents 1 and 2 to provide adequate police protection to the petitioner's company in order to protect the property and life of the employees of the petitioner company including free ingress and egress to the petitioner cotton pressing and warehousing business namely Vijaykumar Cotton Press, at No.2 Vilankurichi Road, Peelamedu, Coimbatore for its smooth functioning on the basis of the petitioner's representation dated 21.06.2021. ORDER
The petitioner had sent a representation dated 21.06.2021, to the Commissioner of Police, Coimbatore/ the first respondent herein, seeking a direction to direct the second respondent to take action against the third respondent, for violating the order dated 20.11.2018 passed in W.P.No.22417 of 2018 and W.M.P.No.26272 of 2018, to maintain the Status Quo.
2.The contention of the petitioner is that the proposed road over bridge project at Vilankuruchi/Thaneer Pandhal road by the Tamil Nadu Highways (RR and NABARD) was challenged by the petitioner for its deviation in alignment as per the scheme road "BB" on the eastern side, thereby the petitioner filed the above said Writ Petition. This Court passed an order dated 20.11.2018 with a direction to maintain the Status Quo, but contrary to the order, they are continuing the construction work. 3.The learned Government Advocate (Crl.side) appearing for the first and second respondent submitted that the petitioner had earlier approached this Court by way of Writ Petition and obtained the order of Status Quo.
If there is any violation committed by the third respondent against the order of this Court, the petitioner has to file a contempt petition and sending a complaint dated 21.06.2021 to the first respondent is not a proper, hence, no action has been taken on a contractual dispute with regard to the construction of bridge. 4.Considering the same, the petitioner had already approached this Court in the above said Writ Petition, therefore, if any violation on the part of the third respondent as against the order of this Court, the petitioner has to file necessary petition before this Court and seeks his direction. 5.With the above observation, the Writ Petition is dismissed. No costs.
