O R D E R

(This case has been heard through video conference) The petitioner who apprehend arrest at the hands of the respondent police for the offences publishable under Section 379 IPC, in Crime No.1234 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the motor cycle of the defacto complainant parked behind his house was missing from the next day. Hence the complaint.

3. The learned Counsel for the petitioner would submit that the petitioner is innocent and that two other accused have been arrested and that the motor cycle has also been recovered. He would further submit that the petitioner's name does not find place in the FIR and the petitioner has been implicated in this case based on the confession statement recorded by the arrested accused. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that there is a previous case of chain snatching against the petitioner and it is the habit of the petitioner to commit theft of two wheelers and by using the stolen two wheelers, he use to snatch the chain of the innocent ladies and he would further submit that there is a previous case in crime no. 355 of 2018 for snatching chain against the petitioner. Hence, he opposed for grant of bail to the petitioner.

5. Taking into consideration the facts and submissions of the learned counsel and that the petitioner is involved in one previous case, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed.
