Rajaeswari ..Respondents PRAYER: This Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorari, calling for the records in connection with the order dated 25.07.2016 passed by the first respondent herein in Se.Mu.Order.Na.Ka.Aa.3/32014/2012 and quash the same as illegal and improper.

O R D E R

The order passed by the District Revenue Officer, in proceedings dated 25.07.2016, rejecting the claim of the writ petitioner for grant of patta is under challenge in the present writ petition.

2. Admittedly, the writ petitioner is the second wife of Late Gurusamy Reddiyar. In respect of the legal heirship certificate, dispute between the family members exists and a civil suit in O.S.No.171 of 2014 was instituted and the said suit is pending.

3. In respect of such civil disputes, the parties are bound to adjudicate the issues before the civil Court and only after reaching a finality in respect of such civil disputes, applications are to be submitted for effecting of changes in the revenue records. Alteration in the revenue records are to be made only after resolving the civil disputes that exists between the parties.

4. In view of the fact that the civil dispute in O.S.No.171 of 2014 is pending, the petitioner is at liberty to submit a fresh application after the disposal of the civil litigation pending between the parties.

5. With these observations, the writ petition stands disposed of. No Costs Consequently, the connected Writ Miscellaneous Petition is closed.
