ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 6(4) of TN Scheduled Commodities [RDCS] order, 1982, r/w Section 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.63 of 2022, seeks anticipatory bail.

2.The case of the prosecution is that during regular patrolling, the respondent Police found the illegal transportation of 6000 Kgs PDS rice in a van by the petitioner. Hence, they registered the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged offence. He would further submit that the petitioner has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that the petitioner is the owner of the vehicle. He is said to have transported 6000 Kgs of PDS rice without proper document. He further submitted that one similar previous is pending against the petitioners. Hence, he vehemently opposed for granting anticipatory bail.

Taking into consideration the allegations and the fact that the petitioner is the owner of the vehicle and he has been alleged to have transported huge quantity of PDS rice to other States and he has also been involved in another case which is similar in nature, this Court is of the view that the custodial interrogation of the petitioner is required in this case. Therefore, this Court is not inclined to grant anticipatory bail.
