Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Mandamus, directing the respondents herein to issue necessary amendment to the final statement issued in G.O.Ms.No.1389, Revenue, dated 11.06.1981 under S.18(1) of the Act and published in the Tamil Nadu Government Gazette No.28-A, Part II Section -I, dated 22.07.1981 for demarcating the lands which are held to be exempted and directed to be deleted from the draft notification and consequently direct the authorities concerned to sub divide the exempted

portions of the land in each Survey number as indicated in the Annexure and issue patta for such exempted portion of the lands to the petitioner herein and his son and handover possession of the said lands to the petitioner herein.

ORDER

This Writ Petition has been filed seeking a direction to the respondents to issue necessary amendment to the final statement issued in G.O.Ms.No.1389, Revenue, dated 11.06.1981, under Section 18(1) of the Act and published in the Tamil Nadu Government Gazette No.28-A, Part II Section - I, dated 22.07.1981, by demarcating the lands held to be exempted and directing deletion of the same from the draft notification and consequently direct the authorities concerned to sub divide the exempted portions of the land in each survey number, as indicated in the Annexure and issue patta.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. Pending Writ Petition, the sole petitioner died long back. Even today, the legal heirs did not take any steps to substitute themselves

in the place of the deceased petitioner.

4. In view of the above, this Writ Petition is dismissed as abated. However, the legal representatives of the petitioners are at liberty to revive the writ petition by way of filing a petition to set aside the abatement. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
