Criminal Original petition filed under Section 482 of Criminal Procedure Code, to transfer the investigation in Crime No.117 of 2018, on the file of 3rd respondent to some other competent investigating agency and further direct the 1st and 2nd respondents to monitor the progress in the case. ORDER

This petition has been filed seeking for transfer of investigation in Crime No.117 of 2018, pending on the file of the third respondent to some other competent investigating agency.

2. This Court, directed the third respondent to file a status report regarding the progress made in the investigation. The status report has been filed before this Court. It will be relevant to extract certain paragraphs from the status report which reads as follows:-

I submit that during the course of pending investigation, on 3.8.2018, the petitioner/defacto complainant sent a another complaint to the Legal Aid Services, Tiruvannamalai and the same was forwarded to the Respondent police, in which he stated that he suspected one Ranjan Kodi, W/o.Late Loganathan, who is the neighbour of the petitioner for missing of the gold ornaments.

6. I submit that based on the above, the respondent police called upon the said suspected Ranjan Kodi, for enquiry. During the pending enquiry, the suspected Ranjan Kodi was tried to commit suicide by pouring kerosene and self immolation since, she was suspected by the defacto complainant.

I submit that during the course of investigation, the then Deputy Superintendent of Police namely Tr.Palani, Rural, Tiruvannamalai has formed a Special Team headed by him along with Tr.Mathiyarasan, Inspector of Police, Tr.Jayachandran, Sub Inspector of Police, and the said team had been taken their sincere and effective continuous efforts to find the accused, who involved in this case. But, no fruitful information about the accused.

8. I submit that during the course of investigation, the then Inspector of Police continuously monitored the Modus Operanding [M.O.] criminals, but no clue about the accused.

9. I submit that during the course of investigation, the then Inspector of Police checked the Jail Release accused persons, but no fruitful information about the accused.

I submit that after my joining, I have been taking my sincere and effective steps to identify the accused, who involved in this case. I have also formed a Special team headed by me along with Tr.Mohan, Sub Inspector of Police and Tr.Palanivel, HC, and Tr.Arivazhagan-HC and the special team continuously taken our efforts to find out the accused.

3. It is clear from the above mentioned status report that the Deputy Superintendent of Police, Rural, Tiruvannamalai has formed a Special Team for the purpose of nabbing the culprit and the investigation is progressing in a proper manner.

4. This Court does not find any grounds to transfer this case at this stage. Hence, the respondent Police shall continue further with investigation effectively and nab the culprit and complete the investigation as expeditiously as possible.

5. Accordingly, the Criminal Original Petition stands disposed of. No costs.
