The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(b), 8(c), 20(a)(i) and 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act 1985, in Crime No.363 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused were found to be in possession of 8 kgs of Ganja and on seeing the police, the petitioner ran away from the scene of occurrence. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that based on the confession recorded from A1, the petitioner has been falsely implicated in this case. Therefore, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) for the respondent would submit that the petitioner along with other accused were found in possession of 8 kgs of Ganja. He would further submit that the petitioner has one previous case pending against him. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into account the nature of offence and antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 05.06.2023 jas
