ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 8(c), 20(b)(ii)(B) of NDPS Act, 1985 in Crime No.43 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other three accused persons were found in possession of 2 kgs. of ganja on 25.04.2022 and thereby the respondent police registered a case against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. He would further submit that the petitioner has been added as a party in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor submits that the petitioner along with other 3 accused persons were found in possession of 2 kilograms of Ganja. He would further submit that no previous case is pending against the petitioner and hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and also the fact that the petitioner along with other accused persons were found in possession of 2 kilograms of Ganja and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner.
