This Writ Petition has been filed to call for the entire records relating to the order dated 04.06.2016 made in Roc.No.11170/2016/K1 on the file of the respondent herein and quash the same and consequently, reinstate the petitioner with all attendant monetary benefits by treating the period of suspension as duty period.

2. The status of the petitioner, pursuant to the impugned suspension order is not clear i.e., whether the suspension order has been revoked or not?

3. However, the counter affidavit filed by the respondent seems to indicate that charge memo was issued to the petitioner. The date of the charge memo has not been disclosed in the counter affidavit.

4. The petitioner was aged about 54 years at the time of institution of the writ petition i.e., on 08.09.2016. Almost 9 years have lapsed, since then the petitioner would have attained the age of superannuation.

5. It is now informed by the learned Additional Government 2/4

Pleader for the respondent that the petitioner has died during the pendency of the present writ petition.

6. Recording the above, this Writ Petition is dismissed and disciplinary proceeding is deemed to have abated. No costs.
