ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 8(c), 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985 in Crime No.66 of 2022, seeks anticipatory bail.
2. The case of the prosecution is that on 04.02.2022, the respondent police arrested the inmates of the petitioner/A1 and A2 and seized 88 packets of Ganja each containing 2 kgs. and the petitioner's name was also mentioned by the arrested accused.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. He would further submit that the petitioner has been implicated in the offence on the confession of the arrested accused. 4.The learned Additional Public Prosecutor submits that the petitioner is A3 and the other accused namely, A1 and A2 were arrested and they were found with 88 packets of Ganja each containing 2 kgs. and hence he vehemently opposed to grant anticipatory bail to the petitioner.
5. Taking into consideration the allegations and also the fact that the petitioner along with other accused persons were found in possession of 88 packets each containing 2 kilograms of Ganja and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner.
