ORDER
The present application has been filed to pass an order, to direct the Respondents to furnish security for the sum of Rs.16,92,440/- within a time fixed by this Hon'ble Court failing which to order attachment of the immovable property morefully described in the Schedule to the judges summons pending initiation and disposal of the arbitration proceedings between the Applicant and the Respondents and till enforcement of the award that may be ultimately passed in the arbitration proceedings and a copy of the attachment order to be transmitted through the District Court, Chengalpattu, and the attachment order may be hand delivered to the applicant for transmission.
2. Heard Mr.A.Damodaran, learned counsel for the applicant.
3. The Court notice that was attempted to be served on the first respondent had been returned with an endorsement "Gone to Out of Station". However, the Court notice had been served upon the 2nd respondent. The Affidavit of Service has been filed enclosing the acknowledgment card, indicating that the said private notice had been served upon the respondents.
4. The present application had been taken out, seeking for a direction to direct the respondents to furnish security for a sum of Rs.16,92,440/- failing
which, the Judge's Summons Schedule mentioned properties standing in the name of the first respondent be attached.
5. It is to be noted that the respondents 1 and 2 are husband and wife, which is evidenced from the loan agreement that has been placed before this Court. The second respondent, being the husband and having received notice, had failed to respond either by being present in this Court or by engaging a counsel. His name has also been printed in the cause list. Hence, no reasons have been attributed as to why he should not be directed to furnish security.
6. In such view of the matter, the application stands ordered prayed for. The schedule mentioned properties described in the Judge's Summons stand attached.
7. This order shall be communicated to the Sub-Registrar Office, Chengalpattu through the District Court, Chengalpattu. 18-06-2026 kak To The District Court, Chengalpattu.
