ANAND VENKATESH CRIMINAL MISCELLANEOUS PETITION No.6799 of 2022 IN CRL.R.C.No.646 of 2022 K.PADMAVATHI [ PETITIONER / APPELLANT / ACCUSED ] Vs S.SARADHAMANI [ RESPONDENT / COMPLAINANT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to exempt the petitioner from surrendering before the learned Principal Sessions Judge at Tirupur in C.A.No. 94 of 2021 dated 27.04.2022 confirming the conviction and sentence passed by the Judicial Magistrate Cum Fast Track Court , Tirupur in C.C.No. 183 of 2017 dated 01.10.2021.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. J.FRANKLIN, Advocate for the petitioner the court made the following order:- This petition has been filed seeking for exemption from surrendering before the Trial Court pursuant to the conviction and sentence imposed against the petitioner being confirmed by the appellate Court.

2. Taking into consideration the materials available on record and the grounds raised by the petitioner, this petition is allowed subject to the following conditions.

"The petitioner shall deposit a sum of Rs.4,25,000/- (Rupees Four lakhs twenty five thousand Only) to the credit of C.C.No.183 of 2017 on the file of the learned Judicial Magistrate, Fast Track Court, Thiruppur, within a period of six weeks from the date of receipt of a copy of this order. If the amount is not deposited within the time stipulated by this Court, it is left open the Judicial Magistrate to https://hcservices.ecourts.gov.in/hcservices/

issue a Non-Bailable Warrant against the petitioner and secure him to undergo the sentence imposed by the Trial Court and confirmed by the Appellate Court."

3. This Criminal Miscellaneous Petition is disposed of accordingly.
