PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for the records of the first respondent's letter No.26527/MMC.1/2002-1 dated 11.11.2002, quash the same and direct the respondents to issue necessary transport permit to remove and transport the silt, earth and sand removed from the Mukkudal Dam of Nagercoil Municipality.

ORDER

The prayer sought for in this writ petition is to grant permission to remove the sand from Mukkudal Dam of Nagercoil Municipality.

2. Since the period already expired, no further consideration is required.

3. However, the learned counsel for the petitioner submits that the security deposit is now lying with the third respondent Municipality.

4. Therefore, the petitioner is at liberty to submit a representation before the appropriate authority and the same shall be considered in accordance with law.

5. With the above observation, the writ petition is disposed of. No costs.
