Respondents PRAYER: Petition under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing respondents 1 to 3 to remove the encroachment put up by respondents 4 to 6 at the door of the petitioner's shop premises bearing New No.35, Old No.16, Gandhi Irwin Road, Egmore, Chennai - 600 008.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard Mr.D.Ashok Kumar, learned counsel for the petitioner; Mr.V.C.Selvasekaran, learned counsel for the first respondent and Mr.S.Kamalesh Kannan, learned Government Advocate for respondents 2 and 3.

2. The petitioner has prayed that directions be issued to respondents 1 to 3 to remove the encroachment put up by respondents 4 to 6 at the door of the petitioner's shop premises bearing New No.35, Old No.16, Gandhi Irwin Road, Egmore, Chennai - 600 008.

3. The learned counsel for the first respondent has filed the counter affidavit of the Zonal Officer, Zone-V, Greater Chennai Corporation, wherein it is stated that respondents 4 to 6 were selling fancy items in front of the petitioner's shop and all the material has been removed from the place in question. The learned counsel for the Corporation further submitted that as of now there is no encroachment at the said spot.

In view of the above facts, nothing further survives for consideration in this writ petition and, therefore, the same is disposed of accordingly. No costs. Consequently, W.M.P.No.27824 of 2016 is closed.
