[ Respondents ] Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of mandamus directing the respondents to dispose of the petitioners appeal dated 27.07.2012 pending with the 2nd respondent under Sec.8 of the Tamil Nadu Liquor (refund of fee) Rules 1981 framed under Tamil Nadu Prohibition Act of 1937. Heard the learned counsel for the petitioner and Mr.A.Kumar, learned Special Government Pleader, who took notice for the respondents and with their consent, the main writ petition itself is taken up for hearing.
2. This writ petition has been filed seeking a writ of mandamus directing the Commissioner (Prohibition & Excise), Chepuak Chennai, 2nd respondent, to dispose of the petitioner's appeal dated 27.07.2012 filed under Sec.8 of the Tamil Nadu Liquor (refund of fee) Rules 1981 framed under Tamil Nadu Prohibition Act of 1937.
3. It appears that till date the appeal filed by the petitioner on 27.07.2012 against the order passed by the Collector of Madras, https://hcservices.ecourts.gov.in/hcservices/
the 3rd respondent herein has not been disposed of by the 2nd respondent. Hence, the petitioner is before this Court. This Court finds no justification on the part of the 2nd respondent in not disposing the same even after three years.
4. Therefore, the 2nd respondent is directed to consider the appeal and pass orders on the same on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
The writ petition is disposed of with the above direction. No costs.
