Application (IP) No.105 of 2023 in I.P.No.96 of 2013 KRISHNAN RAMASAMY, J., This Application has been filed by the Official Assignee seeking to order confirming the sale of schedule mentioned property in favour of the successful bidder Thiru R.Nivas Kumar, Thiruvallur District, for a sum of Rs.4,60,000/- (Rupees Four Lakhs and Sixty Thousand only). 2.Learned Official Assignee would submit that pursuant to the direction of this Court dated 02.01.2023, the property situates at Old No.180, New No.135, Mathur Village, comprised in Survey No.8/7, 10/1, bearing Plot No.A1-121 Ezhil Nagar to an extent of 1200 sq.ft, at Kancheepuram District, Sriperambudur Taluk, was brought for public auction sale on 28.02.2023 at 3.00 p.m through M/s.Alwin & Co., Government Auctioneers in the chambers of the Official Assignee. E.M.D.

for the subject property was fixed at Rs.1,00,000/- and the upset price for the subject property was fixed at Rs.4,00,000/- based on the valuation report received from the valuer. In the auction sale, two bidders were participated and the highest bid amount was a sum of Rs.4,60,000/- knocked by one 1/2 https://www.mhc.tn.gov.

KRISHNAN RAMASAMY, J., rst Thiru R.Nivas Kumar. Hence, the present application has been filed seeking to confirm the sale of the scheduled mentioned property in favour of the successful bidder.

3.Considering the submissions made by the learned Official Assignee and in view of the fact that the upset price was fixed at Rs.4,00,000/- and the highest bid received was Rs.4,60,000/-, this Court is inclined to confirm the sale as requested by the learned Official Assignee. 4.Accordingly, the learned Official Assignee is permitted to effect the sale as per the standard terms and conditions of sale and hence, this application is allowed.
