For Petitioner : M/S.M.RAJENDIRAN Advocate For Respondent : MR. B.RAMESH BABU, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner seek anticipatory bail under section 438 of Cr.P.C. for the alleged offences under Sections 379, 430 & 511 of IPC in Cr.No.276 of 2017 on the file of the respondent police.

2. Heard both sides.

3. According to the prosecution, the petitioner is alleged to have transported the sand illegally.

4. The learned counsel for the petitioner would submit that the petitioner is in no way connected to this offence and he has been falsely implicated in this case. He has no previous case against him. He further submitted that the co-accused A1/driver of the vehicle was released on bail in Crl.MP.No.1659/2017 dated 31.10.2017 and therefore, the petitioner may be granted anticipatory bail.

5. The learned Government Advocate (Crl. Side) would submit that the petitioner is the owner of the vehicle. There is no previous case against him.

6. Having regard to the nature of allegation against the petitioner and taking note of the fact that the co-accused has been released on bail and the petitioner has no previous case against him and as it is not stated that the custodial interrogation of the petitioner is required, I am inclined to grant anticipatory bail to the petitioner subject to the following conditions :-

7. (i) Anticipatory bail is granted.

(ii) The petitioner is ordered to be released on bail in the event of his arrest or appearance before the learned Judicial Magistrate No.V, Vellore, within a period of fifteen days from the date of receipt of a copy of this order on his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the said Magistrate. (iii) The petitioner shall report before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter, as and when required for interrogation.
