Respondents in Tr.C.M.P.No.149 of 2018 Common Prayer:- Petitions are filed under Section 24 of C.P.C., to withdraw O.S.Nos.398 and 414 of 2017 pending on the file of District Munsif Court, Udumalpet and transfer the same to the the file of Additional District Court, Dharapuram, to be tried along with O.S.No.50 of 2018, pending on its file. For Petitioner : Mr.D.R.Arun Kumar in both cases For R1 and R2 : Mr.J.Prithivi in both cases For R3 : Mr.P.Parthi Kannan in both cases COMMON ORDER The petitioner has come out with these Transfer Petitions for transfer of O.S.Nos.398 and 414 of 2017 pending on the file of District Munsif Court, Udumalpet to the file of Additional District Court, Dharapuram, to be tried along with O.S.No.50 of 2018, pending on its file.
2. When these petitions are taken up for hearing, the learned counsel appearing for the respondents submitted that the respondents have no objection to transfer O.S.Nos.398 and 414 of 2017 pending on the file of District Munsif Court, Udumalpet to https://hcservices.ecourts.gov.in/hcservices/
the file of Additional District Court, Dharapuram and prayed for disposal of all the interim applications filed by both the parties and he has also made an endorsement to that effect. 3.Recording the submission and endorsement made by the learned counsel for the respondents, without deciding the issue on merits, the petitions in O.S.Nos.398 and 414 of 2017 are ordered to be withdrawn from the file of the District Munsif Court, Udumalpet and transferred to the file of Additional District Court, Dharapuram, to be tried along with O.S.No.50 of 2018, in order to avoid multiplicity of proceedings and conflicting judgments being delivered by two different Courts. The learned District Munsif, Udumalpet is directed to transmit all the records pertaining to O.S.Nos.
398 and 414 of 2017 to the file of Additional District Court, Dharapuram, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the records, the learned Additional District Judge, Dharapuram is directed to dispose of all the interim applications filed by both the parties, as expeditiously as possible, in any event not later than two months thereafter. 4.Accordingly, these Transfer Civil Miscellaneous Petitions are ordered. No costs. Consequently, connected Miscellaneous Petitions are closed.
