Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to consider the petition dated 20.02.2019 filed by the petitioner under Rule 9(3) of the Tamil Nadu Registration Rules 2000 as amended by G.O.Ms.No.293 Health and Family Welfare Department dated 02.12.2016 and to register his birth as 15.07.1949 and issue to him the Birth Certificate within the time stipulated.

Mr.R.Govindasamy, learned Special Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for a mandamus directing the first respondent to consider his petition dated 20.02.2019, wherein and whereby, he sought for issuance of Birth Certificate.
3. It is stated that the petitioner was born on 15.07.1949 at Melpudupakkam Village, Arcot Taluk, Vellore District. It is further stated that the petitioner's birth was not registered in the official records. It is further stated that the petitioner has requested the second respondent to register his date of https://hcservices.ecourts.gov.in/hcservices/
birth as 15.07.1949 and issue the Birth Certificate. It is further stated that the petitioner has sent a petition dated 20.02.2019 under Section 9(3) of the Tamil Nadu Registration of Birth and Death Rules 2000, amended 2016 as per G.O.Ms.No.293, Health and Family Welfare Department (AB2) dated 07.12.2016 through registered post to the first respondent. The grievance of the petitioner is that the first respondent has not considered the said petition. Hence, the present writ petition.

5. This Court at this stage is not expressing any view on the merits of the claim made by the petitioner, as it is for the first respondent to consider and decide the same. Thus, this writ petition is disposed of, only by directing the first respondent to conduct enquiry and pass orders on the claim made by the petitioner on merits and in accordance with law, after hearing the petitioner and other interested parties, if any, within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
